Draft — not yet legal advice. This document was drafted from how the platform works and is a starting point only. Have a qualified solicitor review and adapt it, and fill in the bracketed details, before you rely on it or open to real bidders.

These terms govern bidding and buying at [Gallery name](“we”, “us”), the sole seller of every lot offered here. By registering or bidding you agree to them. [Confirm whether separate business/consumer terms are needed, and your obligations as an auctioneer in your jurisdiction.]

1. Registration and approval

You must register with accurate details and be approved by us before you can bid. We review every registration by hand and may decline or suspend an account at our discretion. You are responsible for keeping your sign-in access secure; bids placed from your account are treated as yours.

2. How bidding works

Bidding is by proxy: you submit a confidential maximum and the system bids the minimum necessary on your behalf, up to that maximum. You pay one increment above the next-highest bidder, never more than your maximum. The bid increments are set by us.

Every bid is binding and cannot be retracted.A bid placed in the final minutes may extend the lot’s closing time so that others can respond.

3. Estimates and reserves

Estimates are our opinion and are not guarantees of sale price. A lot may carry a confidential reserve — the minimum at which it will sell. If bidding does not reach the reserve, the lot goes unsold. The reserve is never disclosed.

4. Winning a lot

When a lot closes at or above its reserve, the highest bidder wins at the price shown (the hammer price). We will email you to confirm. [State whether any buyer’s premium, taxes, or fees apply — the platform currently treats the hammer price as the amount payable, with no premium.]

5. Payment

Payment is arranged directly with us after the sale; the platform does not take card details or hold funds. We will contact the winner with payment instructions. [Set your payment deadline, accepted methods, and what happens on non-payment — e.g. the sale may be cancelled and the account suspended.]

6. Collection and delivery

Delivery and collection are arranged directly with us. Some lots are collection only, as marked. Shipping and any crating are quoted separately based on the work and your address. Risk and title pass [on payment in full / on collection — confirm].

7. Descriptions and condition

We describe each lot honestly from the work in hand, including a condition report. Descriptions are statements of opinion, not warranties. Lots are sold as-is; you are responsible for satisfying yourself as to condition, attribution, and authenticity before bidding. [Add your policy on authenticity and any returns rights, noting consumer-law obligations that may apply.]

8. Withdrawal and errors

We may withdraw a lot before it closes. If an obvious error affects a sale (for example a technical fault or a clear mis-description), we may cancel it and refund any payment; that is the limit of our liability for such an error.

9. Liability

Nothing here excludes liability that cannot be excluded by law. Beyond that, our liability in connection with a sale is limited to the hammer price of the lot concerned. [Have this clause reviewed — permissible limits vary, especially for consumer sales.]

10. Governing law

These terms are governed by the law of [England & Wales — confirm your jurisdiction], and disputes are subject to its courts.
